How to hire in Poland: match the contract to the software work

How to hire in Poland: match the contract to the software work

Table of Content

Key takeaways

  • Choose the engagement model by examining the actual work arrangement: paid work, employer direction and designated place and time.
  • Software ownership depends on the applicable employment rule or a valid assignment. Repository access and payment alone do not establish it.
  • Compare complete budgets for a defined period, with employer additions, administration, provider fees and exit costs visible.
  • Select a provider after deciding the engagement model. Contractor and employee services have different contracts, responsibilities and fee bases.

Contract for a defined delivery or employ a developer you direct

A software team choosing between contractors and employees needs to distinguish independent delivery from a role it directs. Consider a hypothetical Ruby/API assignment: the buyer defines interfaces, acceptance tests and a handover, while the developer organizes delivery. A continuing developer who takes changing backlog tasks under daily managerial direction presents a different arrangement. The choice affects classification, software rights and recurring costs.

Before deciding how to hire in Poland, write down what the team will actually control. Who chooses how work proceeds? Who sets its place and time? Is the buyer accepting a defined output or directing the person’s ongoing work? Technical code review belongs in either route; it does not settle legal status.

Article 22 of Poland’s Labour Code describes employment as paid work of a specified kind for an employer, under its direction and at its designated place and time. An arrangement meeting those conditions is employment regardless of its contract title. A civil contract cannot replace employment while those conditions remain. Assess the whole arrangement; one meeting or acceptance test does not settle status.

Each model has benefits and obligations:

  • Independent delivery: fits a separable output such as the API module. Agreed interfaces and acceptance criteria define what the buyer receives. The contract needs to address changes, defects and later maintenance; the developer must also work independently in practice.
  • Employment: fits an ongoing developer role under the team’s direction, with continuing involvement as backlog priorities change. The team takes on employer obligations, including payroll, employment records and leave.

A Polish sole proprietorship, commonly called JDG, does not itself prove independence. Neither does a short project. Reassess the model if the API assignment becomes an indefinite role with different working conditions.

Trace code ownership beyond the repository merge

For software created by an employee while performing employment duties, Article 74(3) of Poland’s Copyright Act gives economic rights to the employer unless the contract provides otherwise. This rule is specific to software and those duties; it does not settle ownership of every item the developer brings into the project.

For independently produced code, determine whether the buyer needs an assignment or a license. An assignment transfers ownership; a license grants permission to use the code. The Act requires written form for an assignment of economic copyright. The assignment or license must expressly identify its fields of exploitation: the uses it covers. Check the signature method: a qualified electronic signature can satisfy written-form requirements; a platform’s generic e-signature feature alone does not establish that an assignment meets them.

For the hypothetical API module, keep a delivery file:

  • Scope: the module and agreed deliverables.
  • Acceptance: the approved release and test record.
  • Rights: the signed assignment or license with its defined scope.
  • Components: third-party code and applicable licenses.
  • Handover: documentation and access changes.

For repeatable acceptance checks on delivered code, you can compare these automation testing tools.

Keeping these records together is recommended diligence. Payment and a repository merge alone do not prove a transfer of copyright. If a platform or employer of record (EOR) sits between the developer and buyer, inspect the onward rights chain: employee rights belonging to that employer do not automatically establish ownership by its client.

Price the same work period before comparing costs

Use the same comparison period and state the output each route purchases. The following three-month budgets are hypothetical. The salary, invoice, equipment and internal hourly costs are invented planning amounts, not Polish market benchmarks or statutory allowances. Figures exclude value-added tax (VAT). Add any irrecoverable VAT confirmed for the transaction.

Independent Ruby/API delivery over three months

  • Delivery invoice: PLN 60,000 for the agreed module and handover.
  • Buyer equipment/access budget: PLN 1,500.
  • Buyer administration: 12 hours × PLN 100 = PLN 1,200.
  • Known subtotal: PLN 60,000 + PLN 1,500 + PLN 1,200 = PLN 62,700.
  • Full budget: PLN 62,700 + F + V + X, where F is the quoted provider fee, V is irrecoverable VAT and X is any agreed change or exit amount.

Continuing developer role over three months

  • Gross salary: PLN 20,000 × 3 = PLN 60,000.
  • Equipment/remote-work budget: PLN 1,500.
  • Buyer administration: 24 hours × PLN 100 = PLN 2,400.
  • Known subtotal: PLN 60,000 + PLN 1,500 + PLN 2,400 = PLN 63,900.
  • Full budget: PLN 63,900 + C + E + Y + W, where C is payroll-confirmed employer additions, E is any provider fee, Y is separately scoped exit or replacement coverage and W is any irrecoverable VAT on applicable purchases or service fees.

Employer-financed social contributions make gross salary an incomplete employment budget. Obtain the applicable additions from payroll. Regular remote work under the Labour Code also carries duties concerning tools and costs. Agreed use of personal equipment and occasional remote work require separate assessment. The invented equipment line does not establish the amount legally due.

If you are also setting the salary itself, read how to come up with a competitive compensation package for your employees.

Salary continuing through paid leave is already in the salary budget. Add replacement capacity or an applicable exit leave settlement separately if needed, without charging routine leave twice. The two scenarios buy different outputs, so their subtotals cannot establish contractor savings.

Assign the recurring administration before work starts

Name an owner for each record and approval. For the API assignment, the engineering lead can record acceptance of the release, finance can approve its invoice, and the person responsible for contracts can check the rights instrument. Teams that hire contractors in Poland should connect those records to the independently delivered scope. If actual working conditions require employment, use the employee route and its employer obligations. If invoice volume grows, routing approvals through accounts payable automation software can keep the approval record in one place.

  • Contractor operations: assign scope changes, invoice approvals and signed rights records. Before ending the engagement, check contractual terms and applicable civil rules, outstanding work, payment and handover.
  • Employee administration: assign timely payroll, employment documentation, applicable working-time records and leave records. Statutory exceptions apply to hourly recording, so check the requirements for the role.
  • Employee readiness and exit: have human resources (HR) check medical fitness and safety-training requirements, including applicable exceptions. Obtain advice on the notice, written declarations, exit procedure and amounts for the actual employment contract.

A monthly review should compare agreed scope with actual work. For example, repeated additions to the API contract deserve both a change record and a fresh look at who directs delivery. For a continuing backlog role, assign payroll and leave administration from the start. At handover, confirm documentation and remove access that the developer no longer needs.

Check three providers against the model you actually need

For an independent API delivery, compare platform engagement with services that administer a client-held contractor agreement. Remote and Deel also offer separate employee routes. Check Poland availability, the contracting party, rights documents, recurring buyer tasks and the actual fee quote. Product and price descriptions are current to October 14, 2026.

4dev.com

  • Route: 4dev.com lists Poland for its Contractor Platform. The client signs a business-to-business (B2B) agreement with the platform, which engages subcontractors.
  • Records and rights: it advertises task records and documentation, with an optional rights workflow selected at task creation. The buyer should define scope, record acceptance and check signatures and onward transfer.
  • Price: advertised usage-based service fee of 3% or less, depending on monthly volume, without a subscription; confirm the fee base and quote.
  • Limit: this is a contractor route; it does not provide the employee/EOR option.

Remote

  • Route: Remote advertises Poland contractor management. Its standard product leaves the contractor agreement with the client; Poland EOR is a separate employee route.
  • Records and rights: localized contracts, invoice approvals, payments and records support administration. The client should inspect the intellectual property (IP) clause and signatures.
  • Price: standard Contractor Management starts at $29 per active contractor/month; credit-card funding carries a separate 3.5% service fee. Confirm actual inclusions.
  • Limit: the standard product leaves relationship responsibilities with the client. Separately priced Contractor of Record services use different terms.

Deel

  • Route: Deel advertises Poland contractor services with localized contracts, onboarding documents and payments. Standard management uses a client-managed relationship; check the selected agreement’s counterparty.
  • Records and rights: invoice approvals support recurring administration. Assign buyer approvals and check the IP grant, signature requirements and any onward rights chain.
  • Price: standard contractor management publishes $49 per contractor/month; confirm country/order terms and additional charges.
  • Limit: specialized services that engage contractors on the client’s behalf have different terms and require separate eligibility checks. Poland EOR is available as a distinct employee route.

Questions to settle before signing

Does a Polish sole-proprietor registration prove independence?

No. JDG registration does not decide whether an arrangement meets the Labour Code’s employment conditions. Review actual paid work, employer direction and designated place and time together, even where the signed document describes an independent engagement.

Can a contractor work on a long-running software project?

Yes, duration alone does not determine status. A continuing independently delivered project and a managed developer role require different assessments. Revisit the arrangement when scope or actual control changes; extending a contract does not resolve classification.

Does merging code transfer copyright?

A merge alone does not establish transfer. Employee software has a specific statutory rule, subject to contrary contract terms. For contractor work, inspect the assignment or license, its scope and applicable form, including how rights reach the buyer through an intermediary.

Is a contractor invoice cheaper than employment?

An invoice and gross salary are incomplete comparisons. Define the period and output, then include the relevant employer additions, fees, VAT, equipment, administration and exit items. Different deliverables or unknown additions prevent a defensible savings conclusion.

Can the same provider administer contractors and employees?

Remote and Deel advertise separate Poland contractor and EOR routes; 4dev.com focuses on contractor operations. Select the specific product and verify who contracts with the developer or acts as employer before approving its terms.
